If you go into a rage and throw your computer through the window, and shards of glass/computer then strike random Stanford Fremont fan #1, can you be charged with:

(1) Murder in the First Degree; or,

(2) Voluntary manslaughter (and would this fall under provocation or extreme emotional disturbance and then the partial excuse or partial justification theory)?

At the civil trial, would you be allowed to make a case, or would you not be allowed to do so, under claim or issue preclusion?

Now, if you somehow get off of those above charges and choose to bring action against MLB.tv for the damages to your computer, how likely would a court be to grant summary judgment to MLB.tv? Could you prove their negligence, or would they be able to demonstrate that they met their Hand Formula burden?

Also,

I maintain that this post comes out of law school-induced brain fry.

Don't take this lightly. This is a fantastic accomplishment.

For an old-timer like me who had to endure the drought of 1987-2001, winning the division is signficant. A frustrating 15 years of futility marked by teams that either hoped, sucked, or choked, but never made the playoffs.

I remember listening to Angel games on the radio in the early 70’s…part of the “Tanana, Ryan then start crying” days. The offense those years was just horrible. With a decent offense, Nolan Ryan would have won 20 games 3-4 years in a row.

The Goat Hill Tavern on Newport Blvd (I think—it’s basically right at the end of the 55-South). I saw Napoli, Lackey, Mathis (+girl giving him lap dance), Oliver, Quinlan, Weaver, and Moseley there after Game 3 of the ALDS last year. I’d imagine there’s lots more of them there right now—that, or apparently a place in Yorba Linda.
